Terms of Service

Last updated: 7 July 2026

These terms govern your use of thenighday.com and every purchase you make from The Nigh Day, a sleepwear brand operating from Jakarta, Indonesia. By placing an order you agree to these terms. They are drafted to comply with Indonesian law, including Law No. 8 of 1999 on Consumer Protection and the regulations on electronic commerce (PP No. 80 of 2019).

1. Accounts

You need an account to check out. You are responsible for keeping your password confidential and for activity that happens under your account. Please make sure your address and phone number are accurate — couriers rely on them.

2. Products and pricing

3. Orders and payment

4. Shipping and delivery

Orders ship from Jakarta with third-party couriers. Delivery estimates shown at checkout come from the courier and are not a guarantee. Once a package is handed to the courier you will receive a tracking number by email. See our Shipping Info page for details.

5. Returns, exchanges, and defective items

We do not accept change-of-mind returns. In line with the Consumer Protection Law, items that arrive damaged, defective, or different from what you ordered will be exchanged or refunded — the full procedure and time limits are on our Returns & Exchanges page.

6. Intellectual property

All content on this site — product photography, text, logos, and design — belongs to The Nigh Day and may not be reproduced for commercial purposes without our written permission.

7. Acceptable use

You agree not to misuse the site, including attempting to access other users’ accounts, scraping at scale, or interfering with the service.

8. Liability

Nothing in these terms removes rights you hold under Indonesian consumer protection law. Beyond what the law requires, our liability for any claim related to an order is limited to the amount you paid for that order.

9. Governing law and disputes

These terms are governed by the laws of the Republic of Indonesia. If a dispute arises, we will first try to resolve it amicably (musyawarah). If that fails, you may bring the matter to the Consumer Dispute Settlement Body (BPSK) or the competent courts in Jakarta.
